This website is operated by Hoom Financial Inc. (“Hoom,” “we,” “us,” “our”), a company incorporated in Canada and based in Ontario. The site is a pre-launch website whose purpose is to share information about Hoom and let you join our waitlist. By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the website.
2. Hoom is not a bank
Hoom is a financial technology company, not a bank. When it launches, the Hoom prepaid card is intended to be issued by a licensed banking partner. Nothing on this website is an offer of banking services, credit, deposit-taking, or any financial product or service.
3. Pre-launch information only — no offer
The Hoom product described on this website is not yet available. All information about features, pricing, rewards, interest, timing, and availability is preliminary, may change, and is provided for general information only. It does not constitute an offer, a promise, or a guarantee. Joining the waitlist does not create any account or contractual relationship, does not guarantee access to the product, and does not guarantee any particular feature, price, rate, or launch date.
4. No card-network endorsement
This website does not display or imply any payment-card-network branding. Any such branding will appear only once a card network and issuing partner have authorized its use.
5. The waitlist
By joining the waitlist you provide your email address so we can contact you about Hoom. Your information is handled as described in our Privacy Policy. You can leave the waitlist at any time by unsubscribing or contacting us.
6. Acceptable use
You agree to use this website lawfully and not to misuse it — for example, by submitting false or misleading information, impersonating another person, joining the waitlist on someone else’s behalf without authorization, attempting to gain unauthorized access, interfering with or disrupting the site, or using it for any unlawful purpose.
7. Intellectual property
The Hoom name, logo, brand, content, and design on this website are owned by Hoom Financial Inc. and are protected by intellectual-property laws. You may not copy, reproduce, modify, or use them without our prior written permission.
8. No warranties
This website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or representations of any kind, express or implied, about the website’s availability, accuracy, reliability, or fitness for any particular purpose, and we disclaim all such warranties.
9. Limitation of liability
To the fullest extent permitted by law, Hoom and its directors, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of, or inability to use, this pre-launch website — even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or relating to this website and these terms will not exceed CA$100. Nothing in these terms limits any liability that cannot be limited or excluded under applicable law.
10. Indemnity
You agree to indemnify and hold harmless Hoom and its directors, officers, employees, and service providers from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of this website or your breach of these terms.
11. Changes
We may update these terms or the content of this website at any time. Material changes will be reflected by updating the date above, and your continued use of the website after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts of Ontario, subject to any non-waivable rights you have under consumer-protection law in your home province.
13. General
If any provision of these terms is found unenforceable, the remaining provisions stay in full effect. These terms are the entire agreement between you and Hoom regarding this pre-launch website and supersede any prior understanding on that subject. Our failure to enforce any provision is not a waiver of it.
